Background:
We bought a house from Mr and Mrs Kipiller on October 27, 2003. It was the responsibility of the sellers to fix a few items including roof and electric.
Claim:
Few weeks after being replaced, shingles on the roof went missing.
When we tried to use the warranty, we discovered that the contracts the sellers provided us with were fake.
 In the case of the roof, Mr. Wilkins of Wilkins Restoration does not recognize the document as written by him.
 In the case of BC Electric, BC electric was never asked to perform the work they wrote the estimate for.
Considering we were intentionally mislead by the sellers, we are asking them to pay for the repairs they did not performed as claimed, as well as to reimburse us the $750 we gave them to help cover the costs of the work and time spent waiting for the contractors.
Timeline:
September 2003
- We visited the house
- We made an offer
- The offer as negotiated
- The offer was accepted
September 29, 2003
- house inspection
- problems found:
• main roof to be fixed
• porch roof to be replaced
• AC 2nd floor not working
• dripping pipes in basement
• Fix gutters
• broken windows
• dripping faucet in the bathroom
• Electrical panel unsafe (double wiring)
- The seller is asked to take care of the bold items
- Fax to the seller with the corrective proposal
- The seller answered and agreed
- We accepted to help to cover some cost if we get the estimates
October 24, 2003
- We never got any estimate
- Fax to the seller agent: since we don’t have any estimate we offer only $500 to cover the cost
- We received an answer with 2 estimates for BC electric and Wilkins restoration #3 Wilkins, #4 BC electric)
Oct 26, 2003
- Final walk thru with the son of the seller
- The sellers asked for $1000
- The sellers claimed that they had to wait for the contractors to come
- We settled on $750
- We signed a pre-closing inspection: everything appeared OK.
Oct 27, 2003
- We got the keys
November 2003
- Shingles on the front porch roof are missing (#5 photo)
- We wanted to use the warranty, as written on the estimate
- We tried to contact Wilkins Restoration to get the roof repaired
December 2003
- Fred Wilkins of Wilkins restoration told us that he never worked on the house (#6 statement)
- Fred Wilkins never wrote the estimate (#6 statement) and provide us with one of his actual contract (#6)
- Fred Wilkins looked at the roof and told us that it was never replaced, merely covered (#6 statement)
- We contacted BC electric
- BC electric claimed that they were never asked to do the job, but they did write the estimate (#7 statement)
- We contacted our agent
- Helen Eaton is contacted
- Helen Eaton didn’t have copies of the estimates anymore
- Helen Eaton said on the phone that the sellers don’t have the original estimates either
December 9 2003
- We sent a letter to the sellers with our claim (#8 letter)
December 16 2003
- We received a letter from the seller’s lawyer (#9 letter)
- The letter doesn’t acknowledge the fact that the work wasn’t done, neither the fraudulent document.
January 2004,
- We met with the assistant district attorney and Mr. Wilkins.
- Mr. Wilkins knows where the seller got his contract and signature. He was asked to write an estimate for the seller in March 2003.
- We met with a lawyer: Jeffrey Pollock.
February 11, 2004,
- Jeffrey Pollock sent a letter to the seller.
- We received no answer. |
